Overview

Welcome to Bedouin Coffee Roaster.

These Terms of Service govern your access to and use of our website, online store, products, content and related services. Throughout these Terms, the words “Bedouin”, “we”, “us” and “our” refer to Bedouin Coffee Roaster.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products to you.

By visiting our website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy and Cancellation and Refund Policy.

Please read these Terms carefully before using our website. If you do not agree with these Terms, you should not access or use our services.

1. Eligibility and Accounts

By using our services, you confirm that you are legally capable of entering into a binding agreement or that you are using the services with the permission and supervision of a parent or legal guardian.

You may be required to provide information including your name, email address, telephone number, billing information, payment details and delivery address.

You agree that all information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity carried out through your account. Please contact us immediately if you believe your account has been accessed without permission.

We reserve the right to suspend or terminate accounts that contain inaccurate information, are used fraudulently or are used in breach of these Terms.

2. Products and Coffee Information

We make reasonable efforts to ensure that product descriptions, photographs, tasting notes, roast information, origins and other details shown on our website are accurate.

However, coffee is an agricultural product and may naturally vary between harvests, roast batches and production lots. Differences may occur in appearance, aroma, flavour, colour and other characteristics.

Tasting notes are intended as a general description of the flavours that may be experienced. They are not a guarantee that every customer will experience the same flavours.

The final taste of coffee may also be affected by factors including:

• Brewing equipment and method;

• Grind size;

• Water quality and temperature;

• Coffee dosage and extraction;

• Milk or other ingredients;

• Equipment cleanliness and calibration; and

• Personal taste preferences.

Colours and packaging displayed on your screen may differ slightly from the physical product due to lighting, photography, screen settings or packaging updates.

We reserve the right to amend product descriptions, packaging, prices, roast profiles and product availability without prior notice.

3. Allergies and Product Suitability

Customers are responsible for reviewing all available product descriptions and ingredient information before purchasing or consuming a product.

Some products, blends, flavour additions or products supplied by third parties may contain or come into contact with allergens.

Please contact us before placing your order if you have questions regarding ingredients, allergens or product suitability.

Our products are not intended to diagnose, treat, cure or prevent any medical condition.

4. Orders

Submitting an order constitutes an offer to purchase products from us.

An order is only accepted once we have successfully received payment and issued an order confirmation. An automated acknowledgement does not necessarily mean that an order has been accepted.

We reserve the right to reject, limit or cancel an order where:

• A product is unavailable;

• Product or pricing information is incorrect;

• Payment cannot be authorised;

• We suspect fraud, unauthorised resale or misuse;

• The delivery address is outside our supported area;

• An order exceeds available production capacity; or

• We are unable to fulfil the order for another reasonable operational reason.

If we cancel an order after payment has been received, we will refund the amount paid for the affected product or order.

Customers are responsible for reviewing the selected product, grind type, quantity, delivery information and other order details before completing checkout.

5. Order Cancellations and Amendments

You may request to cancel or amend an order within 15 minutes from the time the order is placed.

Cancellation or amendment requests must be sent immediately to bedouincoffeeroaster@gmail.com and must include your order number.

Submitting a request within the 15-minute period does not automatically confirm that the order has been cancelled or amended. We will confirm whether the request was successfully processed.

After the 15-minute cancellation window has passed, orders cannot generally be cancelled, amended or refunded because we may have started roasting, grinding, packing or preparing the products.

Changes to grind size, delivery address, selected coffee or quantity are also subject to the same 15-minute window.

Nothing in this section limits any rights that customers may have under applicable Malaysian consumer law.

6. Freshly Roasted and Perishable Products

Coffee, food and freshly prepared products are perishable goods.

Unless required by applicable law, these products are not eligible for return, exchange or refund due to:

• A change of mind;

• An incorrect product or grind size selected by the customer;

• Personal flavour preferences;

• Coffee being unsuitable for a customer’s preferred brewing method;

• Improper storage after delivery;

• Brewing or extraction issues;

• Packaging being opened; or

• The cancellation request being submitted after the 15-minute window.

Sale items, promotional items, custom orders, personalised products and gift cards are also non-returnable unless they are defective, damaged or supplied incorrectly.

7. Damaged, Defective or Incorrect Orders

Please inspect your order as soon as it is delivered.

If your order is damaged, defective, incomplete or different from what you ordered, contact us as soon as reasonably possible at bedouincoffeeroaster@gmail.com.

Please provide:

• Your order number;

• A description of the issue;

• Clear photographs of the product;

• Photographs of the external and internal packaging; and

• Any other information reasonably requested by us.

We will assess the matter and may offer an appropriate replacement, store credit or refund depending on the circumstances.

We may be unable to approve a claim where the product has been substantially consumed, discarded or improperly stored before we are given a reasonable opportunity to assess the issue.

8. Prices, Payments and Promotions

All prices are displayed in the currency stated on our website.

Unless expressly stated otherwise, delivery charges, customs duties, import taxes and other applicable charges are not included in the displayed product price.

Prices may change without prior notice. You will be charged the price displayed at the time your order is successfully submitted.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the selected payment method.

Promotional codes and discounts:

• Must be used within the stated promotional period;

• Cannot be exchanged for cash;

• Cannot usually be combined unless expressly permitted;

• May be limited to selected products or customers;

• May be withdrawn or amended where there is an error or misuse; and

• Cannot be applied retrospectively after an order has been placed.

Where separate promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.

9. Wholesale and Commercial Purchases

Unless otherwise agreed in writing, products purchased through our retail online store are intended for personal use.

Wholesale, café, office, event, private-label, OEM or commercial orders may be subject to separate quotations, minimum quantities, payment terms, delivery arrangements and wholesale conditions.

Wholesale customers must not reproduce, alter or remove Bedouin’s branding, product information or labels without our written permission.

Any agreed credit terms, exclusivity arrangements or commercial commitments must be recorded separately in writing.

10. Shipping and Delivery

Delivery timeframes shown on our website are estimates and are not guaranteed.

Orders may be delayed due to:

• Roasting and production schedules;

• Weekends or public holidays;

• Courier delays;

• Incorrect or incomplete delivery information;

• Customs procedures;

• Weather conditions;

• High order volumes; or

• Events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address, postcode, contact number and recipient details.

We are not responsible for delays, failed deliveries or additional delivery charges caused by incorrect or incomplete information supplied by the customer.

Where an order is returned to us because of an incorrect address, failed delivery attempt, refusal to accept delivery or failure to collect the parcel, the customer may be required to pay an additional delivery fee before the order is resent.

Risk relating to the handling and transportation of an order passes to the relevant delivery provider once the parcel has been collected. However, we will reasonably assist customers with genuine courier-related claims.

11. Ownership and Risk

Ownership of products passes to you once we have received full payment.

You are responsible for the products once they have been successfully delivered to the delivery address provided in your order or received by a person at that address.

Where you authorise a parcel to be left unattended, placed at a designated location or received by another person, you accept the associated risk after the courier confirms delivery.

12. Website Availability and Accuracy

We aim to keep our website available and accurate but do not guarantee that access will always be uninterrupted, secure or error-free.

Our website may occasionally contain typographical errors, incorrect prices, inaccurate descriptions, stock discrepancies or outdated information.

We reserve the right to correct errors, update information, change product availability or cancel affected orders.

Where an order is cancelled due to a material pricing or product error, any payment received for the cancelled item will be refunded.

13. Intellectual Property

All content made available through our website and services, including our name, logo, branding, photographs, packaging designs, written content, product descriptions, graphics, videos and website design, belongs to Bedouin Coffee Roaster or is used with permission.

You may access our website for personal and non-commercial purposes.

You must not copy, reproduce, republish, modify, distribute, sell, commercially exploit or use our content or branding without our prior written permission.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

“Shopify” and its related names, marks and logos belong to Shopify or its respective owners.

14. Reviews, Feedback and Customer Content

You may submit reviews, photographs, comments, suggestions or other feedback relating to our products and services.

By submitting such content, you confirm that:

• The content is truthful and based on your genuine experience;

• You own the content or have permission to submit it;

• It does not infringe another person’s rights;

• It is not unlawful, misleading, abusive or defamatory; and

• It does not contain malicious code, spam or unauthorised advertising.

You grant us a non-exclusive, worldwide, royalty-free right to reproduce, publish, adapt and share the submitted content for purposes connected with our business and marketing.

Where reasonably possible, we will not publicly disclose personal contact information included in private customer communications.

We may remove content that violates these Terms or is otherwise inappropriate.

15. Third-Party Services and Links

Our services may include tools, payment gateways, delivery services, applications or links operated by third parties.

These third parties may have their own terms, privacy policies and operating practices. We are not responsible for third-party websites, services or content that we do not control.

Your use of third-party services is subject to the terms imposed by the relevant provider.

16. Shopify

Our online store is powered by Shopify.

Purchases made through our store are transactions directly between you and Bedouin Coffee Roaster. Shopify provides the technology supporting our online store but is not the seller of our products.

To the extent permitted by law, Shopify is not responsible for the quality, safety, delivery or suitability of products purchased directly from Bedouin Coffee Roaster.

17. Personal Information and Privacy

Personal information collected through our services will be handled in accordance with our Privacy Policy and applicable Malaysian data-protection requirements.

We may collect and process information for purposes including:

• Processing orders and payments;

• Arranging delivery;

• Providing customer support;

• Maintaining customer accounts;

• Preventing fraud;

• Improving our products and services;

• Sending marketing communications where permitted; and

• Meeting legal and regulatory requirements.

Because our store is hosted by Shopify, certain information may also be processed by Shopify and other service providers involved in operating the store, processing payments or delivering orders.

You must not use our website or services:

• For unlawful or fraudulent purposes;

• To infringe intellectual property or privacy rights;

• To submit false, misleading or malicious information;

We provide our website, information and products with reasonable care.

However, to the extent permitted by law, we do not guarantee that:

• The website will always be available or error-free;

• Every product image will exactly match the delivered item;

• Coffee will taste identical across every roast batch;

• Products will meet every personal taste preference; or

• Information provided for brewing guidance will produce identical results using different equipment or conditions.

Any brewing recipes, recommendations and tasting information are provided as general guidance.

Nothing in these Terms excludes any guarantee, warranty or right that cannot legally be excluded under applicable Malaysian law.

20. Limitation of Liability

To the fullest extent permitted by law, Bedouin Coffee Roaster will not be responsible for indirect, incidental, special or consequential losses arising from your use of our website or products.

This may include loss of profit, revenue, business opportunity, anticipated savings or data.

Where liability cannot legally be excluded, our liability will be limited to the remedy or amount permitted under applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded.

21. Indemnity

To the extent permitted by law, you agree to indemnify Bedouin Coffee Roaster against reasonable losses, claims or expenses arising directly from:

• Your unlawful use of our services;

• Your material breach of these Terms;

• Your infringement of another person’s rights; or

• Fraudulent or unauthorised activity carried out through your account.

22. Suspension and Termination

We may suspend or terminate your access to our services if you materially breach these Terms, engage in fraudulent activity, misuse our website or create a risk to our business, customers or service providers.

Termination does not affect any rights, payment obligations or liabilities that arose before termination.

Sections intended by their nature to continue after termination, including intellectual property, liability and governing-law provisions, will remain effective.

23. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed where necessary.

The remaining provisions will continue to apply.

24. No Waiver

A delay or failure by us to enforce a right under these Terms does not mean that we waive that right.

Any waiver must be expressly provided by us in writing.

25. Entire Agreement

These Terms, together with the policies and terms referenced on our website, form the entire agreement between you and Bedouin Coffee Roaster regarding your use of our online services.

Any separate written agreement for wholesale, OEM, events or commercial services will apply in addition to these Terms. Where there is a direct conflict, the separately signed agreement will take priority for that transaction.

26. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a restructuring, incorporation, business transfer or sale, subject to applicable law.

27. Governing Law

These Terms and any transaction made through our services are governed by the laws of Malaysia.

Any dispute will be subject to the jurisdiction of the courts of Malaysia, without limiting any right a consumer may have to bring a claim before the Tribunal for Consumer Claims Malaysia or another competent authority.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, policies, technology or legal obligations.

The latest version will be posted on this page with its effective date.

Changes will apply from the stated effective date and will not ordinarily affect orders that were already accepted before that date.
